I authorize GOLDMARK TRAVEL, LLC, to charge the credit card the indicated amount on this invoice. This payment is for the services described on the invoice. I understand that returns, refunds, and cancellations are at the discretion of Goldmark Travel and that the cancellation penalties are per the vendor. I certify that I am an authorized user of this credit card and will not dispute the payment with my credit card company so long as the transaction corresponds to the terms indicated on this invoice.
GOLDMARK TRAVEL, LLC is acting as an intermediary and agent for suppliers identified on the attached or accompanying documents in selling services or in accepting reservations for services that are not directly supplied by this travel agency (such as flights, hotel, accommodations, ground transportation, meals, tours, cruises, etc.). This agency, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on the part of such suppliers that result in any loss, damage, delay, or injury to you or your traveling companions or group members.
GOLDMARK TRAVEL, LLC shall not be responsible for breach of contract in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, or any other actions, omissions, or conditions outside the travel agency's control. GOLDMARK TRAVEL, LLC is not liable for any loss, damage, or delay due to events beyond our control, including but not limited to acts of God, weather events, natural disasters, pandemics, labor strikes, terrorism, or supplier insolvency.
By embarking upon travel, the traveler voluntarily assumes all risks involved with such travel, whether expected or unexpected. Traveler is hereby warned of such risks and is advised to obtain the appropriate insurance coverage against them. GOLDMARK TRAVEL, LLC is not liable for personal injury, property damage, accidents, illnesses, deaths, losses, or delays related to travel arrangements.
It is the traveler's responsibility to provide accurate and complete information (including full legal names as shown on passports), to review all travel documents for accuracy and information, comply with all passport, visa, health, and vaccination requirements, and to make sure they have all required travel and medical documents (passport, visa, vaccinations, etc.). GOLDMARK TRAVEL, LLC is not responsible for denied boarding or entry due to inadequate travel documentation.
GOLDMARK TRAVEL, LLC. reserves the right to charge an administrative fee for cancellations. We strongly recommend purchasing insurance to cover unforeseen illness or other circumstances, such as loss of luggage, medical expenses, trip cancellation, and more.
By submitting a reservation on behalf of any minor or other traveling companions, the person authorizing this booking represents and warrants that they have the authority to do so and agree to convey the contents of this agreement to each such traveler.
Communications and Consent: By providing your phone number and email address, you consent to be contacted by GOLDMARK TRAVEL, LLC regarding your reservation, itinerary, and related travel updates via phone, email, and text message. Message and data rates may apply. Reply STOP to any text message to opt out, or contact jessica@goldmarktravel.com to update your communication preferences at any time.
All disputes shall be governed by the laws of the State of Florida. Venue for any legal action shall be Pasco County, FL. In the event of a dispute, the parties agree to attempt mediation before pursuing litigation. Any claim arising from these terms or the travel services booked hereunder must be brought within one (1) year of the scheduled return date of the applicable trip, or such claim shall be permanently barred.
*** IMPORTANT *** Please be sure reservations are made in the name and date of birth as it appears on your travel document within 24 hours of reservation creation. After 24 hours, a fee can be charged for any changes. All vendors reserve the right to change an itinerary due to weather or other unforeseen circumstances.
Your retention of tickets, reservations, or bookings after issuance shall constitute consent of the above and an agreement to convey the contents here to your companions or group members. This agency is not responsible for any increase in US Government fees and taxes, foreign country departure taxes, fuel surcharges, and/or any other charges imposed by all agencies, cruise lines, tour operators, airlines, etc., at any time before your departure or during your travel.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms & Conditions, together with your invoice, constitute the entire agreement between you and GOLDMARK TRAVEL, LLC regarding the travel services described, and supersede any prior verbal or written understandings.
